Hasbro contro Asus: “Transformer Prime”, atto secondo

Secondo e forse ultimo atto della vicenda di cui aveva già scritto qui a dicembre @itomi, riguardante il contenzioso tra Hasbro e Asus.

La Corte Federale ha respinto le richieste di Hasbro per un rimborso economico e il divieto di commercializzazione dei prodotti di Asus.

Motivazione:

There is nothing gimmicky about the Eee Pad Transformer or the Eee Pad Transformer Prime, nor can it be said that there is any similarity in the use or function between Hasbro and Asus’s products

In poche parole, sembra strano, ma è difficile che gli utenti confondano un autoarticolato Peterbuit rosso e blu da sei tonnellate con un tablet dotato di tastiera.

Nella sentenza, inoltre, il giudice fa notare che è solo nel terzo film che compare un robot trasformabile in un portatile, e per altro si tratta di un Lenovo Thinkpad. Mentre invece la serie Transformers Prime, primo caso in cui sono stati associati direttamente questi due termini, è del novembre 2010, quindi posteriore alla nascita del prodotto Asus.

Hasbro ha già provveduto a comunicare la sua sdegnata risposta:

Hasbro strongly disagrees with the Court’s decision not to preliminarily enjoin Asus’ use of those marks, however we were pleased with the Court’s views on the strength of Hasbro’s TRANSFORMERS and TRANSFORMERS PRIME marks. While the case proceeds toward trial, Hasbro will continue to actively pursue this matter and will take all steps necessary to protect its globally recognized and established marks.

La vicenda, dunque, sembra destinata a non concludersi a breve.
